Contracts
A good contract can prove extremely useful when it comes to enforcement of the contract and relying on the rights contained therein.

We draft contracts from inception, we vet contracts before you sign them to ensure that your rights are adequately protected, and we can facilitate the process at

Trusts
A trust is a legal entity that is able to own property and other assets.
It is an agreement between an owner of assets and trustees
This agreement provides for the trustees to undertake that they will administer the trust's assets with the necessary care to the benefit of the beneficiaries.
This is an efficient and flexible way to ensure that assets are looked after and objectively managed and controlled by appointed trustees in the best interests of the
beneficiaries.

Companies
Registration of a company is regulated in terms of the Companies Act, 2008.

Conveyancing and property transactions
We assist with the transfer of property. Only an attorney who is also admitted as a conveyancer may attend to the conveyancing of property and the registration of mortgage bonds. The conveyancer is usually appointed by the Seller to transfer the immovable property although this can be negotiated between the parties.

Mediation
Mediation is a structured process. It involves parties who are in conflict coming together in a neutral environment to discuss their issues with the assistance of an
independent third party in order to resolve the issues in dispute.
The mediator is the independent third party who is qualified to facilitate the mediation and use the necessary principles to assist parties in reaching consensus
and breaking a deadlock.
During mediation, potential solutions to issues are explored and alternative means of resolving the issues are found to assist parties to reach agreement in a
manner that can preserve the relationships between the parties.
Mediation is a voluntary process and any solution that is reached will be found by agreement between the parties themselves.
The mediator will not decide on the outcome of the mediation but will assist in identifying the issues, facilitating the process and drafting the agreement between
the parties.
Mediation is not an arbitration or legal/court process, where a decision is made by a third party.
The aim of mediation is for all parties to gain from the process (a 'win-win' situation) as well as to preserve human relationships.
We have qualified mediators to assist you in resolving your conflict whether it be a commercial dispute, employment dispute or family dispute.

Arbitration
Arbitration is a faster and often more cost-effective manner in which to resolve disputes.
It is also a less formal and more flexible procedure than a trial.
Arbitrations can also remain private as opposed to trials which are public proceedings.
In arbitrations, the arbitrator can be a person chosen by the parties who has particular qualifications, technical expertise or specialist knowledge relevant to the
subject matter of the dispute which can be a valuable factor in certain specialised matters.
Awards made by the arbitrator are generally understood to be final and binding and may only be set aside in certain limited circumstances.
